Overview

Brian A. Bloom is a partner in the Litigation and Intellectual Property practice groups at Greenspoon Marder LLP’s New York office. With a particular focus on serving as an outside general counsel and strategic business attorney, Mr. Bloom regularly counsels clients creatively litigating or resolving commercial disputes involving or touching on intellectual property issues, reviews and analyzes a wide range of business issues and risk calculation, as well as assists with intricate corporate transactions involving intellectual property issues such as music catalog sale and acquisitions.

As a trained litigator and trusted advisor, Mr. Bloom counsels clients and assesses complex contracts and deals through the lens of risk management, allowing him to proactively see any potential liability risks in advance. With this unique perspective, Mr. Bloom advises on international and domestic trademark and copyright use and licensing, development and distribution agreements, new media use, online business operation and marketing (Instagram, Snapchat, and TikTok), branding, marketing partnerships, and sponsorship/endorsement agreements.

With over 20 years of experience, Mr. Bloom has broad knowledge of all facets of intellectual property rights, litigation, data privacy and cybersecurity, and licensing. He has experience in data privacy issues, navigating clients through complex regulatory environments to safeguard their information and ensure compliance with evolving data protection laws. Mr. Bloom represents multi-industrious clients, including emerging brands, Fortune 500 companies, telecommunication companies, pharmaceutical companies, merchandising affiliates, photographers, and authors to name a few sectors of representation.  His civil litigation experience includes:

Mr. Bloom’s practice also focuses on U.S. copyright and trademark filings and prosecution before the United States Copyright Office (USCO) and the United States Patent and Trademark Office (USPTO), as well as litigating trademark disputes before the Trademark Trial and Appeal Board (TTAB).

Beyond traditional intellectual property law, Mr. Bloom advises clients on cutting-edge new media issues that arise involving social media platform hacking and verification issues. Mr. Bloom drafts and negotiates all types of intellectual property agreements including software developer agreements, work-for-hire agreements, buy-sell agreements, recording, software licenses, joint ventures, trademark licensing, film finance and option, music catalog songs, reality television participation, and development agreements. Notably, Mr. Bloom has defended class action complaints alleging TCPA, ADA, Prop 65, privacy, and security violations. Additionally, he has brought suits against cybersquatters in federal court, ICANN arbitration proceedings, and complex WIPO actions.
