Florida Supreme Court Approves Adult-Use Marijuana Initiative for November 2024 Ballot

In a landmark decision, the Florida Supreme Court (the “Court”) has paved the way for voters to decide on the legalization of adult-use marijuana in the upcoming November 2024 election. The Court, in a 5-2 ruling, approved the proposed ballot initiative, known as “Amendment 3,” marking a significant moment for cannabis reform in the state.

This decision comes after previous setbacks where two adult-use marijuana initiatives were rejected by the Court. However, the tide turned with Amendment 3, thanks to a strategic approach by its sponsor. By leveraging the language of Florida’s existing medical marijuana constitutional amendment and adhering to the Court’s guidance from past cases, the sponsor was able to secure approval for placement on the ballot.

Now, the battle shifts to the court of public opinion as Florida voters prepare to cast their ballots on Amendment 3. Ballot initiatives require a supermajority vote of at least 60% from Florida voters for approval. Recent polling data suggests that the threshold for approval of Amendment 3 is within reach, signaling strong support for the legalization of adult-use marijuana in the state. If passed, Amendment 3 will become embedded in Florida’s Constitution and take effect in May 2025, ushering in a new era of cannabis access in Florida.

As the November election approaches, stakeholders on both sides of the debate will intensify their efforts to sway public opinion and secure victory for their respective causes.
