Newark, N.J. – February 19, 2024 – Greenspoon Marder partner Kelly M. Purcaro and senior counsel Kory Ann Ferro achieved a decisive victory for senior counsel Joseph MacLellan’s private aviation client, Fly Alliance . A recent court order marks a substantial milestone in the ongoing legal proceedings as Ms. Purcaro and Ms. Ferro successfully navigated the legal landscape to dismiss nearly all five counts against the client, as well as all claims against individual defendants comprising the owners and the employees of the client.
The dismissed counts include allegations ranging from one partially dismissed count of breach of contract to counts of fraudulent inducement, and violation of the Delaware Consumer Fraud Act, which were fully dismissed. A fifth count for an accounting was also dismissed, with a caveat regarding its evaluation as a remedy, rather than a cause of action, if further proceedings occur. Claims against two of the three individuals were fully dismissed and the remaining claims against one individual is subject to dismissal absent further support by the plaintiff.
The remaining focus of the litigation revolves around the limited aspects of the breach of contract claim as outlined in the Court’s Order.
Ms. Purcaro specializes in complex commercial litigation across the United States. Her practice focuses on business protection. Ms. Purcaro represents clients in non-compete, non-solicitation, and confidential information disputes, unfair competition, and unfair business practices cases, and defends companies against class actions. Her experience includes contract and other business disputes, restrictive covenants litigation, employment claims, foreclosure cases, and class action matters. In addition to being admitted in the state and federal courts in New Jersey and New York, Ms. Ferro has been admitted to represent clients for specific cases in various other jurisdictions including Florida, California, and North Carolina.
