Greenspoon Marder Client Alert: Follow Up Announcement On Proposed 25% Tariff On $300 Billion of Goods From China

The proposed List 4 China 301 tariffs Federal Register notice has been officially published this morning. This list proposes 25% tariffs on approximately $300 billion worth of imports from China. The publication sets in motion the public comment process. The public comment process gives importers and others an opportunity to present the case for removing products from the list. Products for which there is no other source than China and which cannot be easily sourced outside China are good candidates for removal from the proposed tariff list. The key dates for the hearing/comment submission follow –

June 10, 2019: Due date for filing requests to appear and a summary of expected testimony at the public hearing.
June 17, 2019: Due date for submission of written comments.
June 17, 2019: The Section 301 Committee will convene a public hearing in the main hearing room of the U.S. International Trade Commission, 500 E Street SW, Washington, DC 20436, that begins at 9:30 a.m.
Seven days after the last day of the public hearing: Due date for submission of post-hearing rebuttal comments.

It is important that as many stakeholders as possible testify about the negative impacts of the tariffs. It is even more important that individual companies testify to tell their story about the impacts of the tariffs. The Section 301 Committee needs to hear the specific company stories related to the impacts of the tariffs on costs and jobs and the difficulty in switching supply chains to other countries, if that is even an option.
