In a recent episode of “The Surrogacy Space ” podcast, I was joined by Jeff Kasky, a seasoned surrogacy attorney, to discuss the complexities of surrogacy and the vital roles professionals play in ensuring a smooth journey for all parties involved. Sensitive handling of these relationships is critical, as the emotional stakes are high. We stress the importance of empathy and understanding throughout the entire process.
Health and lifestyle protections are also a crucial part of any surrogacy agreement. Surrogates and intended parents need to agree on stipulations that protect the health of both the surrogate and the child. These protections may include guidelines on medication, health care, and lifestyle choices during the pregnancy. Ensuring these terms are clearly defined helps maintain a safe and healthy environment for all parties involved.
With the legal landscape surrounding surrogacy—and reproductive rights in general—constantly evolving, we discussed the importance of staying informed about changes in the law. The legal framework governing surrogacy can vary significantly by location and is influenced by shifts in reproductive rights, including those related to abortion. Access to up-to-date legal counsel is essential for navigating these challenges effectively and ensuring that all aspects of the surrogacy process comply with the latest laws.
Surrogates often face unique challenges, but their contributions are invaluable. During our discussion, Jeff emphasized that despite the complexities of the surrogacy journey, surrogates deserve recognition for their willingness to help others create families, making their work an essential and admirable part of the surrogacy process.
